I believe the answer is yes, the DA can dismiss or file away the case until a later date depending on statute of limitations of the particular case. I am pretty sure that a case cannot be reopened only if you have already been convicted of or acquitted of that crime in that particular situation. However, I am sure you will receive more accurate info from the experienced and educated advisors of this site. I am simply giving my opinion based on my own knowledge and research.

If further evidence should arise, yes, you could be charged.
