Question about extradition

What is the name of your state (only U.S. law)? PA

I am asking this for a relative.... he lives in PA...original charge was 90/55 in the state of Virginia...he never showed to court...has an FTA for months now. which is now finalized as fugitive status. He said he was pulled over the other day....told to exit car and handcuffed. The officer said he thought it was a PA warrant at first... he explained everything. Then he said the officer came back to him stating extradition is surrounding states...but they still called Virginia to see if they want him. The officer said they wanted him but he said they will let him go which they did and to take care of it. Can they hold him there in handcuffs even if extradition says surrounding states and they were out of the range? Should the officer have just let him know about the warrant and let him go right away? Can they actually take him to jail and hold him there? He's going to get this taken care of very soon. They also told him VA surrounds PA ...the West part of PA but looking at a map that's West Virginia...he feels like they were trying to scare him. He still has to drive to work and such so doesn't want to get taken in until he takes care of it.

Yes, he can be detained while they confirm the warrant. Yes, this can happen every time he is contacted. And, yes, one day the limitation may be lifted and they may say they want to come and get him.

If he wants avoid this inconvenience in the future, he needs to take care of it.

surrounding does not necessarily mean adjacent to or in contact with.


I can see it now; the cops had him surrounded. In your mind it must look like they are all trying to dry hump the guy as they would have to be in contact with him. The term can be used in a less specific manner.

Your relative is a fool for not dealing with his criminal charge.

Don't be surprised if his license is already suspended.

As Carl pointed out - this can happen with EVERY police contact. In a case like this, YES, he can go to jail if the originating agency cannot be contacted.

A warrant is an ORDER of the court to bring a person in front of a judge. That is not blown off by the police, no matter what state the warrant is from. The defendant gets held until a response is received when confirming the warrant.

I have had people held for days over a holiday weekend waiting for an answer from the originating agency.
