reason behind the question


What is the name of your state? georgia

My situation might help with the question asked before. My boyfriend got a speeding ticket for under 15 mph over. He found a technicality(sp?) in the ticket and set up a bench trial to fight it. Yes If it were me and now that the situation is out of hand the ticket should have just been paid. However he had a work emergency and forgot to show up for court and a bench warrant was issued. I called the court to find out what to do from here and they said for him to turn himself in closer to the next court date of Oct 11th. When he did, he didn't get there in time for the court to put him on the calender and they say the next court date is in December. My main problem with this is that he owns a sole propriotership and is the sole provider of him, myself and 6yr old therefore if he isn't working we have no money. After explaining this to the Judge they said they would try to sched. a chamber trial but it would just depend on whether it can be worked in or not. So..he has now been in jail since Tuesday night and hasn't seen a judge or public defender yet and could possible end up sitting there unsentenced untill December. Does anyone have any advice....

It would be best to add this to your original thread. Posting clarifications in new threads tends to confuse the issue and fail to get the information to those who are reading.

In a nutshell, he needs an attorney. I am not familiar with GA law in these matters - and I do not think anyone from GA follows these boards regularly. Court dates are not designed to accomodate the defendant. Sometimes they will bend slightly to do so, but that is not their first concern. The fact he failed to show resulted in the warrant. The court has no way to know whether the excuse is valid or not, and, they do not need to concern themselves with it.

He might need an attorney to help him out of the mess and move on with the hearing.
