What is the name of your state (only U.S. law)? Michigan
My daughter was charged with retail fraud 3rd degree and was sentenced today for that crime. The company she stole from however is telling her that she needs to pay them for civil charges. Can they do that? Can she settle for a lessor amount? no police were called to the scene and the item was returned on site.

Civil penalties are legal and appropriate.

You can try ask for a reduced amount but seriously, don't bank on it.

Sure they can. Michigan has a civil restitution law, it helps retailers pay for the costs of loss prevention when less than honest folks like you daughter steal from them. She can ask for a lesser amount, they will probably say no.
