Rights to information


Utah and Nevada
I have a friend with a Federal Marshal Hold. He is being held in the Davis County Jail in Utah. I am wanting any and all information about his case, i.e. charges whether he has gone to trial etc... My calls and e-mails to the jail and Marshals office denied me any information in the case. What information is public record and what is not? Can I obtain this info. on my own? I am in Georgia.

On a Federal Marshall hold you won't get a thing.

The only information you have a 'right' to is that he is custody.
And yes, you can get that on your own.

There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

Utah Code 63-2-103 allows you access to the following information:

(14) (a) "Initial contact report" means an initial written or recorded report, however titled, prepared by peace officers engaged in public patrol or response duties describing official actions initially taken in response to either a public complaint about or the discovery of an apparent violation of law, which report may describe:
(i) the date, time, location, and nature of the complaint, the incident, or offense;
(ii) names of victims;
(iii) the nature or general scope of the agency's initial actions taken in response to the incident;
(iv) the general nature of any injuries or estimate of damages sustained in the incident;
(v) the name, address, and other identifying information about any person arrested or charged in connection with the incident; or
(vi) the identity of the public safety personnel, except undercover personnel, or
prosecuting attorney involved in responding to the initial incident.
(b) Initial contact reports do not include follow-up or investigative reports prepared after the initial contact report. However, if the information specified in Subsection (14)(a) appears in follow-up or investigative reports, it may only be treated confidentially if it is private, controlled, protected, or exempt from disclosure under Subsection 63-2-201(3)(b).


In other words ... they can tell you why he was arrested and very few other details. the jail where he is incarcerated will have very little information. If you want to know the general (very general) circumstances of his arrest you would have to talk to the local agency that hooked him up. And if it were for a warrant you'd likely get little more than the location, date and time of the arrest, and the nature of the warrant.

If the feds actually hooked him, they are not subject to UT law so they might tell you nothing.

It would supprise me if they released any useful information.

And of course, an OBVIOUS answer would be... that the OP could talk with the attorney for the accused....
