School teacher committing a crime


What is the name of your state (only U.S. law)? Michigan

Last summer, my mother was viciously attacked by her neighbor who is a school teacher. The teacher was charged with assault & battery which was dropped to disturbing the peace. This was the teacher's first offense. What is the law with teachers committing crimes? Is she suppose to report the incident to the school board? If so and she doesn't report to it then what are the consequences? This happened in the state of michigan. Any and all info would be appreciated.

**A: no, she is not required to report it to school board.

In Michigan, usually at the start of each semester, a teacher is required to report any felony convictions, misdemeanor convictions (other than minor traffic violations), sexual crime convictions or suspended sentences, any pending action involving alleged misconduct in any school district, court, or with a licensing agency, any charges or warrants of arrest pending, and if their teaching credentials have been suspended, revoked, nullified or invalidated for any reason.

In Michigan, it is a state misdemeanor to be convicted of disturbing the peace. A disturbing the peace misdemeanor can lead to a 90-day jail sentence. It is considered more than a minor traffic violation, obviously, and must be reported by the teacher to the state.

A failure to report would be considered fraud, material misrepresentation or concealment and, therefore, failing to report a disturbing the peace misdemeanor can lead to the teacher being suspended or fired. Reporting the misdemeanor can also lead to the teacher being suspended or fired.

Here's my advice: the situation is over and done with. The teacher obviously had a clean record to be able to get a "disturbing the peace" charge, meaning she's made exactly one mistake for which she got caught for. She has faced her charges, now let it go.
