Search and SeizureI live in the state of texas, and I was wondering if the police could search my house and seize some items, on (probable cause), without showing a family member a warrant. There are three people that live in the house, me and my parents. If they found something would'nt that be a violation of the 4th amendment? This may have happened over a year and a half ago, and I wonder how long the evidence is still admissable in court, if they ever decide to prosecute.???????? "please reply" |

| Let's see if we have this correctly... about 18 months ago, the police searched your residence using a probable cause warrant and seized some property. You never saw the warrant and no charges have been filed. Is that correct?? If so: 1) What property was seized? 2) What was the 'probable cause'? 3) Have you contacted an attorney?? 4) What did the attorney say about either the possible charges or getting your property returned? 5) Has your attorney determined IF a search warrant was issued and whether it was valid? And to answer your question, depending on the warrant (if one) and a LOT of other issues, any charges that arise from the warrantless search (if one was done) could be considered 'poisoned'. If you want specific answers, you will need to get with an attorney in your area and give him/her the answers to the above questions (and a whole lot more).
__________________ There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution). Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport! |
