Almost a year ago my laptop was stolen. After about 5 months it was recovered by a nearby police agency. They have held the computer as evidence. Recently they brought me I could come in and pick it up, but when I got there all they wanted to do was question me about innapropriate content.


They told me they had obtained a search warrant for my house, then followed me home. I asked for a copy of the warrant, and was told that I would recieve a copy of it, along with a reciept for al litems taken, but until after they had completed the search. My wife was detained by other officers, and not told why she was being detained, even when she asked, they also would not tell her why they were there.

After they left, we reviewed the warrant carefully. It stated the the search was to be conducted during daylight hours. This search was started at 9PM, which was approximately 3 hours after sundown.

What are my chances of having this search ruled illegal?

Somewhere between nil and slight..... and even that only after a full review of the FACTS!!
