Second underage offense.


Im 18, and live in Pennsylvania. I just got my second underage and I want to know if there is anything i can do. My first one was at the age of 17 and I wasn't sure if that one is still on my record since I was a minor then. Also, if it is still on my record is there anything I can do, like appeal or anything to get out. A freind of mine that got one (only one) plead guilty, took the classes then appealed the liscence suspension and won.

Any advice at all would be appreciated

Your post is to vague we need to know the specifics of the charge and details of the bust to offer useful advice.

Alright, the charge is just an underage that falls under "Purchase, consumption, possession, or Transportation of alcohol."

When i got busted i was walking down the street alone, at around 2:30 at night. There was a cop car parked on the side of the road, but I thought nothing of it as i wasnt that drunk, and didn't think I was noticeable. He wound down his window and said something to the effect of have you been drinking, or you look pretty drunk.. He then got out and talked to me, gave me a breathalizer and i blew .24 % he took my information and i was sent home with a friend.

Another thing i can think of, he never read me my rights, and did ask me incriminating questions. Im not sure how this really works, any help is greatly appreciated..

I posted them both at the same time, i wasn't sure which forum to put it in. And i really don't see how "stop drinking" is legal advice

i also got a minor when i was seventeen, but in the state of minnesota, i then recently recieved another minor consumption about six weeks ago, i went to the court house because i thought it was considered my second one. when i got their they asked me how many consumption tickets i had, i replied two and said that i recieved my first one when i was seventeen, they said that was alright and all i would have to do is pay the fine, $162. But that is just in minnesota. i also recieved another minor last night, my second over the age of eighteen.

Because you obviously didn't get it the first time, the law applies to you too, not every other person BUTT you. Don't expect to get a slap on the hand this time and expect to loose your license for a time. If you don't drink you won't have to worry about underage drinking tickets, nor would I listen to advice from a person with 3 underage citations. You stand a better chance with the court if you show that you are willing to abide by the law, so it would be a wise idea to look into joining AA, it will help you quit drinking, and show the court you made a good faith effort without having to be court ordered.

why join AA? im not anywhere near an alcoholic.. Are you even telling me that you didn't drink in college.. Even if you didn't im sorry to say that i have.. I am going to stop drinking here, and definietly not walk around intoxicated or anything that could risk me getting caught.. Getting drunk at a party on a friday doesnt make you an alcoholic. I just wanted to get legal advice, which i thought this forum could provide.. I thought maybe one of you had heard of or dealt with something like this and could help me.

Bad Luck? Is it bad luck that you cannot even capitalize? Alcohol related tickets are not just bad luck.

Your bad luck will cost you dearly in the big world outside of your problem. You have a drinking problem.

Your parents must be so proud. I am confident enough to say, that you will lose your license, and if your parents are smart they would invest in a rehab for you, instead of paying for a education at Deluth that you are clearly not into, or even at.

You have a serious alcohol problem, and you hijacking threads only brings the attention of that fact, right back at you.

Pardon me for not capitalizing my prior statement.

As I do not know the consequences of other states I simply stated that I was from Minnesota.

To clear up the part about this being my second underage consumption citation and going to the courthouse, that’s what I did, I went to the courthouse, not in seek of a judge, but to simply pay my fine. There was no judge involved to call me “cute.”

My parents are proud of me, contrary to your belief, I graduated third in my class with a grade point average of 3.97. I am also maintaining a B average thus far in college, even with my questionable term papers.

Before you profile someone, be better informed.

"Stop drinking" is pretty good advice, I think. How do you expect anyone to have sympathy for you when you have a demonstrated history of disobeying the law, and you fail to learn from your mistakes?
