Seizure under Art. 18.10 vs. Art. 59

What is the name of your state?
TX

If property is seized under Article 18.10 instead of under the forfeiture article 59 what is the difference? Is the return of the property pending on a conviction? Who has the right to petition the court for return of property - the person in possession of the property at time of seizure or actual owner of property if it is leased equipment?
