I went to court for my first hearing for a felon with firearms, Mandatory 5yrs(plead not guilty). I found out that if the police have a search warrant for you and your home they can first detain you while they search your home even if you are not home. Well the question now is that in the affidavite or however you spell it states that a CRI (confidential Reliable informant) said that he seen at my place of residence 40 lbs of weed. That is a bold face lie and I believe he did it just to cover his azz and jealousy being that we just bought our first home and a 2002 Navigator. All of this was with credit so now I risk losing it all because the search found 2lbs of weed and 2 handguns. being a convicted felon even though im not on parole or probation means I could go for 5 to even 15yrs in prison. I will lose the house and the car and also the four children that I help raise. Is there anyway to challenge the credibility of the CRI(snitch). Who was actually a so called friend of the family. If this is possible the search will be invalid therefor dropping the guns. I do admit I am a smalltime nickle and dime weed seller but I do not deserve all of this just when my life was just getting together. I know a lot of people frown on this but I really do need help, I just had my first son was working till the police picked me up there, have two daughters and raise a nephew who mother OD'd on heroin last year.

You mentioned nothing, absolutely nothing about drugs except for the fact your previous arrest was for possession of a firearm and simple possession (drugs)!

Now it turns out the warrant was for drugs, the firearms were found incidental to the search for drugs, and they seized your cash because you are alledged to be a drug dealer.

The informant claimed he saw 40 pounds, they found 2 pounds. You want to challenge his credibility? At the present his credibility rating is 100, yours is 0.

On what possible grounds do you think you can get the warrant quashed?

IMO, the only way out of this if you had information worth going to the feds. They could make your present case disappear if you work with them. But
on a practical level it will only be a little while until you are in over your head again though. You seem to be incapable of learning from your mistakes or of those close by you .

First of all I expected the responses I recieved secondly your probably right but before you judge you walk in my shoes. Im not looking for sympathy im looking for help you try to get a job with a felony on your record especially after 911. I was working in a marketing department doing real well left for a better job offer and ran into predjudice and its been struggle ever since. The guns were not mine my cousin brought them to my home that morning with the spare keys she held cause of problems at her home and we have a police report to kind of collaborate that even though the timing couldn't have been worse. The 2 lbs of weed is nothing their not even charging me with that. Not trying to make it look like nothing but the snitch is a bigger drug dealer than me and anyone I know. (probably cause the police allow it) But to lie and say I was doing that much is crazy and thats all they need to search. So if this so called person doesn't like you, you yourself could be greeted by the finest in your city. All im saying is there should have to be more than word of mouth and yes I do know the snitch. Brought my son diapers and exchanged baby stuff like real good buddys. first of all brake pedal you never lived in my shoes and I probably do have more education than you, and when once did I say it wasn't my fault? I just asked for some good legal advice not some ritzy white kid who say they had it rough cause they had to walk to school. I graduated, got a C.N.A. degree, went to the U of M. Well this is my last response since I couldn't get any help but prison does not scare me, been there done that. Besides Im a made man coming from money which was not why I was here. Just some simple yes you can challenge or no for the sake of my kids, but you'll probably say "or there better off with out you" and thats probably why your paying child support now. I only want the best and the same for my kids but took a wrong turn, thats life. You never made a mistake or had too probably. well im done thanks for the advice so now maybe your tax dollar can raise them if worse comes to worse.
