Son's arrest


What is the name of your state?

my son is currently on probation for drug parafinelia (not sure on spelling) and defacing a weapon and has been for 3 months. on 10/12/04 he was with a 23 y.o. who was extremely drunk. he recently got out of jail one week prior and who is also on probation. (this other person has 13 charges on his past record for various reasons ranging from abuse to d.u.i.s to probation evasion) the two stopped into a pizza parlor where my son's "friend" was very loud and unruly and they were asked to leave, which they did.

while walking home, (they left the property and were on a sidewalk) the two were stopped by police and questioned if they had been drinking. my son told the officer no, but the one who was drunk told him to "tell the truth and to let them know he was drunk"! long story short - my son was asked to do a breathalizer and told the officer that he wanted a blood test instead. the officer waved a pencil in front of his eyes and determined he was drunk never giving my son an actual test. my son was ticketed for criminal trespass and minor consumption and taken to jail. the other boy was not taken to jail even though he was ticketed for criminal trespass and contributing to the delinquency of a minor.

how can this be - i mean i know my son is in the wrong for being with this other person to begin with and i know that he will go to jail for a long time now, but how can this other person get away without any jail time at all. i don't understand this at all.

i spoke with the boy who was with my son that night and he admitted to me how drunk he was and that he was so scared of going back to jail that he told the cops that it was my son who was drinking.

is there anything at all that i can do to help my son or is this basically it for him...i keep hearing from everyone that he will spend the remainder of his probation in jail - which is 3 years. the prior convictions are his only ones...

just that money obviously talks louder than justice since the other person comes from a background of money and deserves to be locked up but isnt and my son is?

Diamond, I'm afriad you won't find any legal advice here. Please check any of the other posts to see what responses people give here. There are nothing but people without lives here trolling.
