What is the name of your state? Virginia

Is there a statute of limitations on a Class 6 felony? The case has been open for over a year now, and it will be for some time. (Still no trial). At what point, if any, can it be thrown out? (Please site relevant State codes/cases).

Generally, the statute of limitations looks at the time from when the crime was committed to when chares were filed. Since in your case, the charges have been filed, your should be concerned with your 'right to a speedy trial'.

The time limits for this depend on the state and on the circumstances of your case. For example, actions by your lawyer which cause delays would toll (suspend during the delaying time) the time limit.
