What is the name of your state (only U.S. law)? Pennsylvania
i had a summary charge of retail theft in 2002. i payed the fine, no jail time,no community service. is there anyway i could get that off my record, but the clerk at the courthouse said its not a record.

Summary charges generally don't show up on public criminal background checks.
Obviously the state does keep track of them (the police can look them up for instance if they're investigating you for something else).

There is NO expungement of convictions in PA anyway, summary or misdemeanor until you turn 70 or die (which ever comes first).
