summons disorderly conductWhat is the name of your state? NY (NYC) Hi, I been harressed by my ex-girlfriend's ex-boyfriend (life threats, egging of the house, etc..) for the past month. Have two harrasment reports from the Police. Yesterday, I received a phone call from my ex and she said he was going to jump off the school campus building and to be prepared to call the police, I got worried that he might take her with him when he jumps, so i called her parents and we rushed to the school. We contacted security and found them, and he had calm down by the time we got there. So, as we walking downstairs to fill out some paperwork, he ran off and I figured he was running to my house to wait for me to come home to attack me. As we were all walking out of the school, the security guard was escorting us to the car, but the guy was hiding behind a pillar and then assaulted me as i passed it, i was able to defend myself by blocking his punches, i did not return any blows, only defended, and the security finally managed to retain him after a long time. Once, I got free from his grip and security retained him, i called the cops. The cops came and i told them the situation, they asked if i had cuts or bruises, i said no and then they said they cant do anything about it. So, i further explain the seriousness of the matter, and that he was really out to get me, they sympanthized with me and told me to get a restraining order against him and said they would give him summons for fighting in public if i wanted, so i said ok. Then the lieuntant comes by and saids your both getting a summons, he also would not talk to me, but the 5 other officers on the scene assured me that i would not get a summons and would talk to him. they talked to him and he saids to be fair "you both have to get a summons", since this was there boss they said they agree with me but have to listen to his orders and i was issued a summons of 240.20 for fighting in public. I'm just really frustrated with the legal system, when i was the victim here, and there were plenty of witnesses (it was in front of a college campus), the security guards witnessed the whole matter and even told the lieuntant, i didnt even touch the guy except to defend myself by blocking his punches. Anyway, my question is, do i need a lawyer to fight this? will this be on my record or come up on any background checks (i can not have anything on my record, im just starting my career..)? Also, can i appear before the date on the summons? Can i take any legal action against the lieuntant for abusing his power? Many Thanks for any help. |

| Ok , look when whomever received the first call about your x's , X possibly going to a roof and jumping off , a simple 911 call could have been placed . Instead you rushed right over there , instead of letting the authorities handle it . You were then advised to get a restraining order . You chose to carry it further piratically begging for something else to be done . After the first 2 times being harassed , you should have gotten a restraining order . Now go tell your story to the Judge .

| thanks for the reply..i think... ...sounds like you agree with the lieutant giving me the summons then.... ![]() i will get the restraining order, but that takes a lengthy time and during that time he can do anything. anyway, does it sound like i need a lawyer to fight this? and does anyone know if i can appear earlier than the date on the summons? this is very frustrating, being a victim and just trying to help someone yet still get punished for it... |
