My wife was arrested in Tennessee for possession of a controlled substance when a police officer found a small packet of what could be meth between the mattress and box spring. What is crazy is that the hotel manager gave the police the key to her room before she had occupied the room but after she had paid for it (she was on the Internet in lobby while they entered room). Her case was nulled but we are sueing police and hotel for violation of civil rights (she was also strip/body cavity searched in room by police dispatcher). Can the manager give the police a key without a search warrant?What is the name of your state?

There is no where near enough information to make any judgment here. Some issues which arise are obvious, some not.

If your wife never occupied the room, how can she be in possession of anything in it? Was this some sort of sale where the previous renter made a deal with wife beforehand? Did the manager call the police or the reverse? (Was the manager acting as an agent of the police?) How do the police link up a small amount of drugs in a hotel room with the occupier? Must we all search each hotel/motel room we enter to be safe? What if we don't search as well as the police do?

How about telling the whole story rather than the little snippet you think is important. Any search issue is the totality of the circumstances. What were the circumstances?

What does her attorney say about the strength of her case? Certainly he or she has told you how good a case she has, right?

I agree with Tranquility - there is too little known to make an informed decision, and it is apparent that some level of detail is missing.
