Underage Drinking Ticket


North Carolina. Last night I was downtown and the ALE raided all of downtown last night. I was in a club and I walked outside and when i tried to go back in, the bouncer told me that I was too drunk to go back in and would not let me go in. I was not being wild or crazy or stumbling around everywhere. So I had to stand outside and wait for a ride. While I was standing outside, the bouncer pointed me out to the ALE. The ALe guy came up to me and started yelling in my face, cursing at me and saying "do you know who I am, look at my badge" and being COMPLETELY out of line. I was not resisting or doing anything wrong but he was being a complete jerk about the whole thing. He told me to sit on the ground and wait. Another guy took me to the car and started putting my info in the computer. He asked me how much I had to drink and I said that I had 2 beers. I did not drink at all in the club. How can they prove that I was drinking? They did NOT breathalize me or catch me drinking at all. Because I'm 19, they said I did not have to go to court and I could just plead guilty and pay the $145. I am wondering whether or not I should go to court and get lawyer? Would it really be benificial to me?

You told them you were drinking. That's how they can charge you. If they need more they have the officer and the bouncer's observation of your intoxicated state.

Never accept legal advice from police officers, I think the fine is a bit more than 145$, hell I got a speeding ticket and it was 185$ (oddly enough, I wasn't speeding, but I didn't contest it, long story).

If I was a lawyer, you think I'd be giving free advice? ok, I would, but thats besides the point.

Don't take my word on these things, look up the laws yourself. Look for your state's legislature page, you can find them there.

There are a wide range of people on this forum, don't expect all of us to be friendly, especially if you are not.

I guess


I guess my question is, is it worth my time and money to get a lawyer, or should I just pay the ticket off? The ticket said that I they had right to believe that being 19, I consumed A malt beverage at 2:23 when in reality, I hadn't drank in the past 4 hours.
