I was at a friend's apartment where alcohol was present but i wasn't drinking. I went outside to meet a friend and as soon as i opened the door a cop appeared on the walk way heading towards the front door. He asked, "Do you live here?"
I replied, "No I don't." he then asked, "Could you go get someone who does?" I replied, "Yes sir." then shut the door. No one answered the door after that because everyone was scared the cop was going to bust them. Eventually the cop left.
Months later an individual who lives in the apartment got an underage possession charge. The cop's statement is that he talked to someone who answered the door who was holding a bud light bottle.
This clearly is a mistake in identity however I was in no possession of alcohol and did not drink that night.
The individual went to court with a public defender but got a continuance for his charge and informed he was going to purchase a legitimate lawyer. What is likely to happen to him and me? This happened in Virginia.What is the name of your state (only U.S. law)?
