Unlawful confinement?

What is the name of your state? Virginia is the state of which this question relates!

A man was arrested in Virginia for possession of a controlled substance (powder residue - nothing more), speeding (82/65), and driving with a revoked/suspended license (CDL). He was arrested on 07/24 and his court hearing is set for 12/21 (5 months!!!). No bail hearing, nothing - everything pending until court..... is this legal?

The person arrested does have a prior conviction for a felony (intent to distribute), served his time, parole, and all but 6 days of his probation. The probation office in New Mexico released him... knowing about the arrest in Virginia but says that he's been clean and no violations for 4 years - they are not going to use the arrest in Virginia as a violation of probation.

by the way the powder substance came back negative....
