VA Expungement?

What is the name of your state (only U.S. law)? VA

I was arrested and sentanced in MD and receieved PBJ-Probation before Judgement. In March I can petition MD to have my record expunged. However, I was living in VA at the time and was originally arrested in Fairfax Co, posted bail and returned the next day for a hearing. At the hearing VA released me so I could drive to MD to turn myself in, which I did.

My question is, since there were no actual charges in VA and once the charges in MD (knock-on-wood) are expunged, can I get my arrest in VA expunged?

On the face of reading the law, you are not eligible for expungement. If such had happened completely within VA, it certainly wouldn't. How the fact that the case was tried in MD may affect that will probably take a lawyer (in VA) to look at.
