Verbal Threat?


What is the name of your state (only U.S. law)? California

Yesterday my husband went to work and was yelled at by employer and fired when he asked what was going on she yelled at him and within minutes the police were there saying that someone called saying he was making threats...he surrendered they threw him down anyway broke his glasses & cut his head then arrested him...now he is in jail till monday and then goes to court i have no idea what to do i can't post bail i am just scarred that they will keep in jail or something please help any advice is appreciated.

well, with you having such little actual knowledge of the situation, there is little anybody here can offer. I suspect if he is being refused bail for the moment, this is much more serious than a simple offense.

You will either have to wait until his bail hearing (presuming that is what he is attending Monday) and act as needed then or contact an attorney to seek info on the situation.

If your husband cannot afford an attorney (and this is per the courts view of your situation, not merely you saying you can't afford one), one will be appointed for him.
the fact they "threw him down" does not sound like your husband was cooperative. That does not bode well for him.

It may be hard but it doesn't sound like there is anything you can do for him until monday.

I doubt you are getting the whole story. The employer (or someone) likely did not call the police because your husband asked why he was being fired ... something more happened.

Second, the police didn't just show up and decide to drop some poor schmuck to the ground without cause. Chances are he did something to warrant the attention. If not, then he can speak to an attorney about suing the police. But, I strongly suspect HE did something to bring on the pain.

If you are unable to raise the required bail money, you will have to wait until Monday and hope the judge lowers the bail. There is always the chance the DA will decide to drop the charges by then as well. You may just have to wait and see.
