| | | Violation of Probation Warrant Questions What is the name of your state? Louisiana
I was sentenced to five years of supervised probation for a theft charge almost a year ago. As a condition of my probation, the judge ordered me to make monthly payments for restitution, court costs, and fines, and to have the sum of all of those fees paid within the first 3 1/2 to 4 years of my probation. I was also ordered to pay $450 in attorney's fees to my public defender and $200 in court fees immediately, which I did. I reported to my probation officer as directed and communicated with him via phone and email when he or I had questions or concerns.
He mentioned that he was seeking other employment and, after the first 6 months of my probation, he told me he his last day would be in two weeks and my new probation officer would be in touch with me soon after that. I was never contacted, but I continued to send in my monthly written reports as usual. I could not afford to pay the monthly restitution payments, in addition to my other debt/living expenses, and got behind on my payments so my husband and I sold our house and moved into a small apartment to save money. My PO had knowledge of this before his departure, but he apparently did not pass this information on to his successor because someone from his office called me. She said that a VOP warrant had been issued and I needed to report to the court ASAP to "take care of the warrant." When I asked what the violation was, said she was just making some phone calls on behalf of my new probation officer (who will be out until next month) and could not give me any additional information, but she did ask me if I had permission to move.
I'm really confused and I don't know what to do or even what to expect when I go to the courthouse. Will I be handcuffed and arrested? Will I be thrown in jail until I can afford bail? Will I have to pay the entire amount I'm behind on restitution before I'm released? Should I call my public defender first? What is the name of your state? |

Well IF you do not Show up , you defiantly will be looked up .
Go in and explain your story . Tell the Judge this was a miscommunication issue , and you have been following all orders except your in a bind for making restitution payments right now . You should have a least attempted to sent 5 or 10 smackaroos at a time .
No one can tell you what the Judge may do . He may let you go until your PO comes back , maybe not .
