What kind of warrant is this?


What is the name of your state? Texas. What type of warrant is a capias pro fine warrant. I looked up my name on a county site and on an old ticket ('02) for speeding it said that there was a capias pro fine warrant issued in '07. I took driving school for this ticket 6 years ago and sent in all the paper work as required and on time, now this shows up. When I looked up on the active warrant page they don't show any warrants for me. This has to be a screw up, but I'm sure I don't have the paperwork anymore to prove I took care of this ticket. Am I screwed? Why the hell would they wait 5 years to issue a warrant if there was a problem?

Capias pro fines are warrants issued for not paying a ticket. You can call the JP or municipal court issuing it and ask them to check their records. If they can't find the record of you taking the driving course than yeah unfortunately you might be screwed and be forced to go in and pay off the amount owed.

I've seen how JP courts run behind the scenes and it can be very scary. Records get lost and screwed up all the time.

Follow up question


Now on the county website under the active warrant page my name shows up. My questions are how long does the courts exspect you to keep the paper work for a ticket, hell the IRS only requires 4 years for your taxes. Lastly, is there a time limit for them to issue a warrant for something like this? I have looked and can't find the paperwork for this and know I'm going to get screwed with out it, is there any hope of going in and talking to the judge and explain my situation, or will it just fall on deaf ears?

Do you have check records whereby you could trace the check # for the fine and the one for the driving school ?
You can get a copy of the checks from the bank (front and back, sowing endorsement) for a nominal fee (it will take them a while to locate them).

Go to court. Ask the Judge to recall and hold the warrant to allow you time to prove there was an error in crediting your payment and proof of school. Or just explain the situation to the Judge.

Be sure you're correct in everything you state to the Court.
