| what are my legal rights? My husband was recently arrested. In a nutshell....he was intoxicated at his own house. Neighbors called police. He had a mild confrontation w/ police outside of home. Police told him to go inside. He did. He laid down in his bed. The police entered the home after hearing some arguing (from his aunt and her husband, he was laying down). the police came into the room and started shining flashlights in his eyes and poking him. When he stood up and asked what they wanted, he was immediately pushed onto the bed and arrested. He was literally drug out of the house kicking & yelling...we still do not know why he was arrested. He was shackled by his hands and feet and beaten with batons in front of many witnesses. He has nerve damage in his hands (severe scarring as well from handcuffs) and damage to one knee where he was beaten w/ flashlights while handcuffed. When he got to jail he was told he was being charged with "refusing search and transport" and "assault of a public servant." (FYI: We live in Texas). My husband has never been in trouble with the law. This is a very little town that this occurred in (population 1200). He was arrested outside of the city limits and we were told only the sherriffs dept has juridiction there, but the report shows a city police officer as the arresting officer. We go to the "arraingment" in a month. We do not know what to expect. We want to talk to an attorney, but will have to settle for a public defender, as we do not have funds avail. for private one. Will we be assigned a defender before he pleas? Will we be able to get advice and know our options before we go before court? How does an "arraingment" work? We are so confused and scared. Can u tell us what to expect and how can we get this dropped! Thank you so much! |
