Wisconsin - Indiana out of state warrant?I was recently arrested in West Lafayette Indiana, (after a Purdue football game) for Public Intoxication. Basically i saw some kid getting arrested, he was making a scene and swearing as the cops were putting him in cuffs. He was being cuffed right next to me as I was walking and I said "that friggin sux" and chuckled a little. The cop asked me if I thought it was funny, and being a little intoxicated and believing my answer was covered under the 1st amendment, I said "yeah, it is kinda funny, cause i wouldnt wanna be him right now." The cop slapped me in cuffs and stuck me in the back of the car, and told me to shut the **** up. I assumed he was trying to scare me, and was going to toss me out of the car before he took this kid in. No such luck, I was booked and spent 12 hours in the Tippecanoe county jail, A real **** hole. When they brought me in i my Blood Alcohol level was .11, so I remember everything. I was never read my rights, when I asked what I was being arrested for they would only tell me PI, but I didnt know what that meant at the time and they refused to explain it to me. I was never told that I would not be able to post my own bond from the money in my wallet, or even that I could post bond. I wasn't told how long I would be in for. I was not told that my only opertunity to use the phone would be during a 1 hour free time. Nothing. I got out and I came back to my home state of Wisconsin, after 12 miserable hours my friends were able to pick me up. I was never given any paper work telling me what I was charged with, or the arresting officers name, nothing. Just a letter a week or so later telling me I had a court date. If I dont show up for the initial court appearance and they issue a warrant in indiana, will it affect me as long as I do not go back to Indiana? | Stop watching tv. You only need to be read your rights after an arrest and prior to an interrogation. Lack of rights read merely mean that anything you say in such an interrogation couldn't be used against you in court, not that the charges magically go away. Everything else they "refused to tell you"? Yeah, although they need to tell you eventually, they're not really under any obligation to do so "right away". And nice try with that first amendment bit. Yes, your speech is protected, but not your public intoxication. Let's be a little smarter out there, yes?

| Im glad that you can read, but I was looking for a response to the question, not a commentary on the situation. I did not ask if I could sue the state of Indiana, or if I could get my case thrown out because I hadn't been Mirandized. I asked if I could be arrested in Wisconsin for not showing up to my scheduled court date in Indiana. Yes, I realize I was infact intoxicated in public. Its a load of crap that I was arrested for being drunk while the other 40,000 plus students around me were also drunk. That means that any person can be arrested for having consumed several drinks, something that is infact legal. Its crap, but its the law. Im not asking if I can slide out of the charges on a technicality. I just want to know if I will be arrested in my home state of Wisconsin, for paying these charges from Indiana the attention they deserve, none. And im sorry if my attitude seems out of place to anyone else who reads this. I don't think that asking for help in a forum called "Free Advice" entitles people to belittle me. If you want to help I truly appreciate it, but don't just berate me because you think I am an idiot. |
