wrong race on disorderly conduct ticket

What is the name of your state?I got arrested in philadelphia for urinating outside a bar. The officer put black as race on ticket and I'm obviously white. I pleaded not guilty and have my court case really soon. Can i fight mistaken identity on this charge. Any advice is appreciated

Of course you can offer that as a defense. However, I think that your name, DOB and drivers license number, etc. will kind of 'trump' the race card..... and probably be pretty positive on the ID thing.

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

Unlike the old South Africa, the United States does not yet have legal definitions of who belongs to what race. So, no matter what he put down for your race, that alone would have no bearing on your case.

If the cop can identify you, then that's all he has to do (plus, of course, prove all the other elements of the charge).

Future court proceeding -->

Prosecutor to officer: "Officer _____ , can you please identify the urinator for the court? Let the record reflect that Officer _____ , indicated Mr. ____ , as the weeny urinatee."

Further.....
Court: "Officer, can you explain why this ticket shows this person to be black... when he is clearly not?"
Officer: "Yes I can. When I witnessed this 'drip' peeing, I yelled at him. He turned toward me.... and in the process of trying to keep my shoes and uniform dry, I made an error."
Court: "Since the citation shows the incorrect race for this defendant, is there another way that you can positively identify him?"
Officer: "Yes. The citation has his correct name, correct address, correct DOB and correct drivers license number."
Court: "Thank you. Guilty. Next case."

Pisser prevails

I piss where I want and can't anyone stop me!! Actually, I'm not in a lot of trouble....I beat the ticket because the cop didn't show up for court today. Just wanted to rub it in all your faces who doubted my case. On the record, I just pissed all over you. Get a life.

Okay, so you got lucky. That doesn't mean that you aren't guilty of the charge.... or that your aren't an idiot.
