Wrongly accused of shoplifting


What is the name of your state? MA

Your Question:
I was accused of stealing lip gloss or mascara, they didn’t know, at a food store. After paying for my items I was stopped, brought into a back room and kept there. I request that they call the police because I never stole anything and I was confused, embarrassed and felt violated, they wouldn’t call the police, I wouldn\'t let them search my bag without the police there, they did anyway. From the time they stopped me, to the time they let me leave was about 15-20 minutes. I called the police when I left who told me to file a report about being held somewhere again my will. I don’t think what they did was legal, if it wasn’t; I would like to take action. Thank you

yes, I called in a phone report. They said someone would call me back with details....

Were the items mentioned recovered? Yes it sounds as though this stores security did not meet the requirments for a stop. Now you could sue but that could tak a year or more an your Attorney may want monies ahead of suit! Call corparate office to complain as well you might get a hefty gift card for your troubles. Did you get names of those who stopped you? They should be fired!

No nothing was recovered! I didnt steal or even conseal anything!! Get this though! I did call headquarters for Shaw’s and he said:

Yah I heard about that, I haven’t looked at the tape or talked to anyone yet but, I understand why they stopped you, it’s our store policy that you should not pick up an item and place it elsewhere, I mean just like perishable items…And I said “It wasn’t, and that’s not the point!” and he said I mean, it’s something I’ll look into but, it looks suspicious … are we going to confront someone that (AND I QUOTE, HE SAID THIS) DUMPS a product BEHIND an isle” yes, of course, and I said “ I didn’t DUMP something BEHIND an isle, I changed my mind and put it down!!!! They didn’t think it looked suspicious that I was dropping it somewhere and confront me… they thought I stole it and took me in a back room and looked through my purse! Is that your store policy?! And he said “Like I said, we will look into it”

He could have cared less!
Ah, I mean I am sure he thinks I was planning on stealing it or I did SOMETHING wrong, I don’t know. I am sure 99% of people the stop do steal something, but this was a complete mistake on their part and no one cares! It just frustrated me because I didn’t do ANYTHING wrong!!

They don’t confront people who change their mind and put something back down! And that’s all I did!

Are you saying that you were detained in a store for 15-20 minutes on suspicion of shoplifting but no one has charged you with anything?

No one charged me with anything because we watched the tape and they searched my bag, I DIDNT STEAL ANYTHING! So yes, I was detained in the store, they wouldnt let me leave..we watched the tape and i said "See there, i placed it down" and then she said "you can go"

It's a little difficult for any of us to evaluate your case since we have not seen the tapes, etc.

Thus, if you cannot put a dollar amount on your damages, I will say you have no case.

No damages, no case.

Yah the tape is CLEAR AS DAY that I didn't steal, I mean if they were at all careful and watched the tape again they would have seen it...
its ok, I'll let it go

Laws vary from State to State soem concealment is a crime other snot. was item placed on shelf an item that would spoil if left in area you dumped it? I am not looking to say your wrong but looking at all possibilities keeping in mind we havent seen tape nor heard grocers view! You might best to just shop elsewhere

It was NEVER consealed! They couldn't see it in on camera angle, and my cellphone rang and I went into my purse, to go into my purse I put the chapstick down in an isle (I think cereal) but then left it there. They saw the item in hand, saw me put my hand in purse, saw the item out of hand....if they pressed REWIND and weren't stupid overvelous loss prevention people they would have seen what i saw item in hand, (CLEAR AS DAY PLACES THE IDEM DOWN IN AN ISLE) saw me put my hand in purse, saw the item out of hand.

LOL I am getting more mad as we talk abou it..
No I am going to shop elsewhere..its a pain though, i live in the city and dont have a car!
THANKS for your help, you guys calmed me down and made me realize its nuts to go looking for a lawyer, my friends were like "CIVIL RIGHTS, blah blah"
