17 year old son hits car head on with serious injury

Hello. Our 17 year old son was riding a 4 wheel atv and was on the paved road and hit or was hit by a car head on in a turn. He was air lifted to Schands and was seriously injured with the affects still being felt and found years later. My wuestion is this. We are being hounded daily by a law firm representing the insurance the Car owner had that he hit hounding us for payments for repairs to the other car.
While we believe our son was at fault he did not receive a citation for this accident and are just not sure if we are legally responsible to pay for it..
I am legally blind and still trying to get disability benifits and our son is back in school trying to complete his edgucatuion after having to drop out due to pain in his back from accident.
Aby help in this qurstion would be greatly apreciated.

How many years ago was the accident?
Why isn't your insurance company handling this?

the accident was in november of 2007.
Our insurance company is not handling it because there was and usually not insurance on a 4 wheel atv ( 4 wheeler)

You're also not supposed to be riding an ATV on the road where cars can hit it. If your son was at fault for the accident, then he is liable for the damage he caused, regardless of whether he got a citation. It is POSSIBLE that you would also be legally liable, but no way to say for sure on a forum like this. You should consult a lawyer for options. If you are sued, you will have to present a defense.

It is possible to get ATV insurance, which anyone crazy enough to try riding one of those death-traps should get.

There is no good news here for you. Your son was riding where he was not supposed to be. That's why there are laws against riding a 4-wheeler on a public road.

In this area, not a week goes by during the summer where a young person has been life-flighted to a hospital because they had an accident on their 4-wheeler. At least this poster's son lived - that has seldom been the case this summer. None of them were wearing any protective gear - I guess they think it's too geeky. We're having funerals for 12 and 14 year olds in this area.
