18-wheeler accident


What is the name of your state? TX
My daughter was driving on the highway on the right lane with the speed limit. An 18-wheeler was in the left lane. The driver did not see her car and turn to her lane. He hit her 1996 Mercury Mystique car. Her car flew over the highway rail, rolled over and landed on the service road upside down. The car was totaled and my daughter came out un-touched. The police and the emergency crew arrived in just few minutes. They found my daughter completely safe and the truck driver admitted his fault. Allstate insurance company had the car since last Tuesday to come up with the final estimate that they will pay me for her 10 year old car with only 52,000 miles. Since last August 2005, this car cost me $2,700 in repairs. The blue book said the highest price is $3,900. Do I really need an attorney even my daughter is not harmed.

You will be offered fair market value for the vehicle. Unfortuately for you, all the money you put into repairs does not mean the car is worth more. You put $2700 into the car to make it worth $3900, without the repairs, the car may well have been worth $1200. If any of the repairs were required to keep the car on the road, it would have been worth less than $1200. $3900 would be a very fair offer for the vehicle. Hiring an attorney would be throwing away money for such a small claim.
