18 year old daughter crashed my car


What is the name of your state? Illinois

My stepdaudghter who just turned 18 took my car, not her car for witch she has liability and property damage ins but no collision, and accidentally ran over a small tree in someone's yard with my car. The tree needs to be replaced and some sod and there is considerable damage to bumper and hood. My car has full coverage.

With her 100% at fault does she file a claim under her insurance and if so would the damage to my vehicle be covered under her insurance that is the minimum required by the state of IL that doesn't include collision? Or do I have to file a claim under my insurance with her as the driver at the time of the accident in order repair my vehicle since she has no collision coverage?

I'm hoping her insurance will cover all without mine getting involved or incure any "blemishes" on my insurance record. I am also hoping to avoid having to make two separate claims and having to pay both deductibles ( she still lives at home and attends high school and we pay for her insurance ).

The insurance follows the vehicle. You file the claim with your insurance company, pay your deductible, and have your vehicle repaired. Then you ask your step-daughter to repay you the deductible since she was at fault.

Her insurance wouldn't pay to repair your vehicle since she didn't strike your vehicle. There aren't 2 deductibles to pay. There is no deductible to repair the damage that you cause to other people.

So would this show up as an accident for me, her, or both? By both I am wondering how does that show up, obviously she will have been shown at fault in the accident, but from an insurance standpoint will I be 'punished' for making a claim and not being the driver?

Isn't it kinda late to be considering the repurcussions? Accidents follow the driver, but your insurance company will pay the claim, which will not make them happy. They might, depending upon circumstances, add your step daughter to your policy.

FYI BECAUSE IF YOU HAVE CAPS LOCK ON WHEN YOU POST THE REPLY IT AUTOMATICLY LEAVES THE FIRST LETTER CAPITALIZED AND CONVERTS THE REMAINDER OF EACH TYPED WORD INTO LOWER CASE

It was an honest mistake. Someone gave me a pass on stupidity 20+ years ago in similar circumstances so I guess I can do the same. Live and learn. I'm just glad nobady was injured.

Its interesting that you say that, because in your first post you were concerned about how this would affect your premiums, and about the 2 deductibles you thought you had to pay.

We all make mistakes. We don't always get a 2nd chance.
