1998 not at fault and fighting

1998 P.I.P lawyer says if I don' allow insurance to use additional pip coverage my insurance will be in a position to move the courts for order dismissing my case. I do rceive ssd. due to injuries which my lawyer says my rear end was very minimal and the defendant will claim injury are not all related to 1998 accident. I have back injury along with scmold nolds, encrochment,areas of abnormal signal are seen anteriorly edd plates. None of this was on the 1997 mri from 1995 accident. What to do? Should I let them use my P.I.P or take a chance with the court? i reserved my pip for loss wages. Should I exhaust my pip and pay medical bills with this as I can. Leaves no potential for loss wages. >>Can I back up to 1995 for help with my medical bills? I was never paid for my injuries from 1995.I did not know that I had rights. Two carpal tunnel surgery, damage knee, cervical, l. shoulder, Right toe broken.

Unless you have a "Med-pay" policy along with your PIP you cannot force the PIP carrier to reserve for lost wages and hold off paying medical bills.

There is conflicting case law on the statute of limitations for making PIP claims in Florida. One says it runs five years from the date of loss and the other says it runs five years from the date your claim is denied by the carrier. Check with your attorney.
