4 Car Collision

What is the name of your state? My state is Pennsylvania:

I was in a four car collision on July 3rd. A Dodge darted from a side street and hit a Cavelier on my road (the main road), spinning her around. I was sitting in traffic at a complete stop, caged between two other cars so I had no where to go. She stopped spinning then came at me. She hit me in the driver’s side, totaling my car, then hit the BMW behind me. Now there’s a bunch of problems. We found out the guy who started the whole mess (the Dodge) didn’t even report the accident until yesterday, July 12th. He lives in sub-city housing and only has very limited coverage (about $5,000). My insurance guy is telling me that they will end up splitting the $5,000 between me and the two other cars that were hit. However, they won’t split it fairly. They go according to car worth. Since my car was the oldest they are now telling me I will only get 10% of it’s worth which may end up to be $100 (if that, because my car was a 1984 OldsMobile Firenza) plus I am now responsible for paying the impound bill which is $500 at the moment and still rising. I don’t see how any of this is fair. I have to get rides, I have no hope of getting enough for another car from them now, they won’t let me do a rental because no one’s covered for rentals, plus I was injured during the crash and dealing with my injuries now (my insurance is paying for that). I asked my insurance agent if the man who drove the Dodge that started it all has nothing, then can I sue the woman driving the Cavelier he hit who hit me? But he doesn’t want to even hear about it because it turns out she happens to have the same insurance company I have (which is State Farm). I feel like I am getting the runaround here. What can I do?

My response:

Make a claim against your own insurance policy under the "Uninsured / Underinsured Motorist" provisions. If you didn't have that coverage, then you're on your own. Sure, you could sue the tortfeasor - - but that, and a dime, will undoubtedly do you absolutely no good.
