My daughter was in an accident and the insurance company is the same for both parties. No traffic ticket was given. The other car made a left turn in front of my daughter who was traveling straight thru an intersection. Other driver says she had the arrow to turn, but my daughter says she had a green light.
Now Allstate says that they want to give my daugher 60% fault and the other driver 40% even though they say they cannot prove who is at fault!!!!!!!!!!!!!!! I am enraged. Is this insane or what?

If there were no witness then most of the time the insurance company have no choice but to find both parties responsible because he said/she said don't count. Most of the time it is 50/50 however I am feeling the reasoning of the 60/40 may be because had your daughter been driving a safe speed through an intersection and driving more defensely she would have been able to stop to avoid a collision.

My daughter was driving 30 in a 45 mile zone. There were 2 witnesses we got names and phone numbers of but so far my adjuster won't talk to them because they were not on the police report. I am beginning to consider this a matter of bad faith.

Why didn't the police put those names on the police report?

The policeman did not ask any of the witnesses for statements. My daughter was being treated by emt most of the time. After everyone had left (except my daughter) the policeman asked her if there were any witnesses. She said, "YEs but they are already gone." Fortunately she had asked the man who helped her out her car to leave his name and number with her......policeman also said all traffic lights were in "Perfect working order" when in fact one of the two green lights on the other drivers side was burned out...I have a statement from the city stating this...poor police reporting if you ask me.
