About to lose my license


What is the name of your state (only U.S. law)? The matter happened in Ohio

In 2004 my mother was in an accident, rear ended, by a man and was eventually found at fault because the car was not insured. The car she was driving was registered in my name. At the time of the accident I lived in Florida, the car was being stored in Ohio. She should not have been driving it, but also should not have been at fault for being rear ended.

The man filed a claim, about 3,000 for a small fender bender was awarded to him, and the insurance company has sued me. Between 2004 and now I have moved from Florida to California, I had no idea of the status of the case until I pulled my credit report last year. I had not received a notice, signed no papers, nothing, not received a phone call, nothing.

My mother takes full blame for the incident and has tried to make arrangements with the law firm to pay off the debt, but she's elderly and is on a fixed government income, I myself don't have any money to pay for this either, but they are saying they are going to suspend my license which will cause me not to be able to work, handle my business, or function in California.

What can I do to keep them from taking my license? I don't care if they mess up my credit, I just need to be able to drive. I didn't even live in the state when this happened.

Why wouldn't you be able to work if you lose your license? California does have public transporation you know.

don't do that, I have a brand new car that I have the right to be able to drive. Now please give me advice on what I can do to keep my license, or don't reply at all

pay off the debt in it's entirety. and btw, driving is a privilege, not a right.

and FYI, i LOVE the public transportation in Cali! except on hot summer days when the air on the bus isn't working....and the one person that forgets to put on deodorant stands right over me in an overcrowded bus.

You only have the right to drive that brand new car as long as you have a license. A license in the State of California is a priviledge ~ it is not a right.

Are there any useful replies on this forum? I have a right to be able to drive my car because I'm not at fault in the case. Do not reply unless you have some useful information for my situation.

FYI I used public transportation for years, which is why I got a car.

no one can tell you what you should have done. "insure the car you had your mother hold for you".

you don't want to go after mom who was physically responsible.

then you pay the bill YOU are legally responsible for.

it's pretty simple. pay the bill, or get your license suspended. there is not magic formula in legal language to make your problem go away.

Would I be legally responsible for something that happened while I'm out of state? In actuality I would need to go after my mother, legally speaking she is responsible. Unless you have a helpful answer, don't reply.
