Accident. Chiropractor Unlicensed No Satellite License


What is the name of your state? CA

This is not my case but I told I would help out. The man is about 70 yrs old and he was rear ended. Vehicle Damage is about 2000.00. He received 4-5k in chiropractor damages, however, the Claims examiner found that the chiropractor, although licensed, was not following section 308, to have a satellite license for the facility he was treating in. The insurance company spoke with the chiropractor, and he stated he will not charge for the treatments because of his corner cutting. The question here is can this man still sue for pain & suffering? Example first claim he gave was something like, 5000 * 3. = 15000. Can he still do 2 * 5000 p&s? And -5000 for no bills. It is a unusual situation, I look forward to replies. Thanks.

Pain and suffering isn't ACTUALLY based on what the medical bills cost. That's just a guide.

Make sure the chiropractor puts it in writing that he is waiving his bill.

General damages is hard to determine just based on what you posted. What were his diagnosed injuries? how long did he treat? Did he fully recover? What is his medical history? how much damage to his vehicle and the other vehicle? Did he treat or consult with any other doctor or clinic?

What is the chiropractor's name?

Excellent reply. I contacted him and he said he was in treatment for 4-6 months. (Not sure on exact date). Shoulder * Neck pain. He is 70. He was rear ended. He did a mri * 2 to check what was causing the shoulder pain. He is old so naturally he has previous injuries. Some of these injuries were noted as above to the shoulder. So they recurred. 2 years has since elapsed since original date of accident. Thanks.

If you are in southern california, his general damages would typically be less than the chiropractic bill. So you are talking about 2-3k in general damages (pain and suffering).

What is the chiropractor's name?
