Accident/Civil Suit (18 years old)


What is the name of your state? California

About a year and two months ago (i was 17), I was in a traffic accident where I was found to be at fault. I didn't get any tickets or citations, but was the one in violation. Both myself and the lady involved were insured, and damages were somewhat moderate (bent bumpers). Both my passengers, myself, and the other driver seemed to have no injuries whatsoever, and both parties drove the affected cars away. However, I have now received a summons identifying me and my father (who owns the car) as codefendants in a, "unlimited civil case (exceeds $25,000). We're being sued for "wage loss, loss of use of property, hospital and medical expenses, general damage, property damage, and loss of earning capacity." I just am wondering what the outcome of this suit likely would be. Is this lawsuit just a frivolous attempt to get at our money (she already fired her first lawyer)? I'm pretty sure that her injuries, if any, were not serious (I don't think she declared any injuries at the time of the accident). Our insurance company, Geico, is handling the case. Do these claims usually win against the insurance companies, and if so, what are average awards for what seemed like a rather minor accident?

sorry, but with the limited information you provided no one can say what the value of the case is against you.

let your attorney hired by Geico know your concerns. The attorney is in a better position to tell you what injury claims are being made, their validity and possible value of the case.

The vast majority of claims settle before trial, especially if there is no issue of liability.

just to throw something in.. just because she did not report any injuries at the time of the accident does not mean a damn thing, so that statement is worthless.

i'll tell you what though, your only defense (in my opinion) would be to prove that the damage to the vehicle was not strong enough to cause that much damage to her body.

however she can always get bull**** reports that she's been having back problems forever and a slight "touch" causes extreme pain, etc...
