What is the name of your state?

On may 6 2003, I had an accident involving a drunk driver. I lost my van it was totalled. The accident happened at a light when the drunk driver turned in front of me. This was very traumatic. I have injuries to both Knees and hips. Since then I have had pain and stiffness and am now on anti-depressants. I guess my questions are:
Can I sue the person that was following her?(to make sure she was okay, she refused to let anyone drive her)
Since I have not been able to work we are losing our house and bills are going unpaid. What can I do about that? (My lawyer states that he would like to wait a year before settlement).
And finally, What will happen to her?

No. That person didnt cause the accident and had no legal duty to you.
