we live in camden, arkansas and my husband hit a parked truck during the first ice storm in december (december 16). The insurance company paid for the truck that was hit, our problem is this, the truck sat there for 3 weeks (in a curve, on an incline, next to railroad tracks). we talked to several people that have also come close to hitting the truck and know that the school buses almost hit it. we also know that the sheriff's office was aware of the truck being there due to the fact that they go to the school to prevent violence from occuring. our car was totaled and we were wondering if there is anything that we could do to recoup our damages. any assistance that you could give in this matter would be appreciated. we have tried contacting attorneys in our area, but all have refused to talk to us.

Generally it is a drivers responsibility to avoid all road hazards irregardless of the weather conditions. Your only option would be to check if there are any laws in your jurisdiction concerning vehicles parked or abandoned on roadsides. Laws of this type usually only apply to freeways and limited access highways. Even if the vehicle was illegally parked, you would have a very weak case in seeking compensation. That is why none of your local attorneys will pursue a case.
