Accident happened at dealer lot


I am in LA, California.

Dropped off my BMW at a dealer lot for service. Got a call in the afternoon saying that another customer reared into my car which was being driven by the dealer's technician. The dealer filed a claim with the other driver's insurance but it turns out, the driver is specifically excluded from the insurance company.

The service manager is out on vacation so I have not been able to talk to him about next steps. But so far, the dealer has NOT been cooperative, apologetic, NOTHING.

What recourse do I have?

find out from the dealer who is their insurance carrier. ask for the carrier of their garage policy. did the accident happen on the dealer's lot?

forget talking to the service manager. ask to speak to the head of the dealership about getting your car fixed and having a loaner car in the meantime.

OR

you can make a claim with your own carrier. your carrier will pay for the repairs less your deductible and then go after the dealership and the other driver for reimbursement. your rates wont go up.

The accident happened on the dealer lot. When I asked who the head of the dealer was, they said that they have a service mgr. and a sales mgr. but not one single general mgr. I have a feeling that I'm getting the runaround b/c a) I'm a female & b) I'm Asian.

I don't want to take legal action but if I do, will the law be on my side?

Front hood of the car smashed up and front bumper. Needs new hood & bumper.

Have you contacted your own insurance company? In Michigan, we have a no-fault law which would cover your car in instances like this.

Generally, if the damage is minimal then the insurance co will "forgive" this type of claim and not cause your deductible to go up.

*** When I first read that, I assumed that you were incorrect and that someone had 'rear-ended' YOUR car.

However, when you later said that the damage was to to "hood of the car smashed up and front bumper", makes me wonder. Are you SURE that the dealers driver didn't rear-end someone else???

I would suggest that your first step is to get ALL the facts in writing from the dealership. This could be done in person by 'interviewing' the responsible representative and making notes and/or by sending the dealer (to General Manager) a letter asking him/her to provide you with a WRITTEN statement from the dealership as to what happened and who ALL the drivers/owners involved were. There is possibly a different scenario then they are claiming.
At the same time, tell them that you EXPECT them to provide either a loaner vehicle or a rental vehicle to you at no cost at least until they can provide their written explanation.
At the same time, I would suggest you talk with YOUR insurance company to get them involved.

There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!
