| My husband was involved in an accident in Maryland on Rte. 495 at 3:50pm. He was driving an F600 truck, pulling our 33 foot boat. The weight of the boat and trailer is about 16,500 pounds. I was the escort vehicle. An 85 year old man from Yonkers, NY was driving about 30 mph in the right lane when he decided to change lanes in front of my husband. It was so short that the man never quite made it into the lane. Our truck hit his left rear with our right front. Thank goodness, my husband was able to keep the truck and boat straight. An independent witness pulled over and gave his statement to the police and to us. We contacted the 85 year old man's insurance company to get the ball rolling. They have since decided that the accident was my husband's fault, that my husband was changing lanes and are disregarding the witnesses statement. My questions are, how can an insurance company totally disregard and independent witnesses statement? AND, if we want to pursue this in small claims court, where do we file? The accident happened in Maryland, he lives in New York, and we live in Virginia. |
