Accident I have no Insurance with Drunk Driver


Wisconsin

I have been driving around without liability insurance and I slowed to a red light without coming to a complete stop and took a right hand turn and collided into another vehicle. That driver was drunk and was speeding past the speed limit through a yellow light. He was arrested for a DUI and has liability insurance. My truck is only worth $500 and I don't know if i can be held liable for that or if there is some law in wisconsin making him completely liable for being drunk?

Who was found to be at fault? Him being drunk is not good but if you hit him then you are to blame and therefore you need to suck it up.

Based on your post, you were the at fault party for the accident. Being drunk, speeding and running a yellow light does not make the other driver automatically at fault. If you were insured, your insurance company would likely place a percentage of the blame on the other driver. You could still end up getting cited for your part of the accident plus have your license suspended for not having insurance. Don't be surprised if the other driver's insurance company contacts you and asks how you plan to pay for the damage you caused. At this time you best option would be to lie low and not make any waves.

Weel, there's good news and bad news. The bad news is that, since you had a red light, you were supposed to stop. When you don't have insurance, you don't do stupid stuff. Seriously. You were more at fault in this accident than the other driver. The good news is that, since WI recognizes comparative negligence, the amount awarded by you to the other party, will be reduced by the % of fault that he is assigned. Since you will likely be determined at fault, you cannot recover anything from the other party.

The other bad news is...if you cannot settle the "financial judgment" against you, you will lose your license.
