Accident involving motocycle police


What is the name of your state? Virginia

What are the rules involving a police motorcycle driving without siren or lights on the wrong side of a 2-way, double-yellow lined street? The police position is that their (emergency) vehicle always has the right of way yet they did not charge the driver of the car involved in the relatively minor (no injuries) accident.

Could you flesh out the situation a little bit?

The police generally need to have their lights an sirens on to support an exemption from ordinary traffic laws, however you do not really supply enough contextual information to say anything.

Each state has statutory requirements for emergency vehicles to violate the laws. CA requires a single red light to the front. Look up the VA statute for this in the vehicle code. (Google is your friend.)

You can pursue it against their insurance or have your insurance company do it for you.

It would seem that they had no basis to ignore the law. They have to be responding to an emergency call AND using lights or siren.
