If you were owner of the car, then yes you can be sued. You need to check your policy to see if your insurance would cover him.
Why in the heck wouldn't you have him on your policy?
1.) Check with insurance company, if that falls through then;
2.) get an attorney.
3.) If you get sued and lose then you can sue your son.
