You don't sue anyone. You can't. In this circumstance, your only option is Workers' Compensation.
Now, you could also make an "Uninsured Motorist" claim against your own auto insurance; however, every penny they pay you would have to be returned once you obtain a Workers' Compensation settlement. So, stick with WC.
