I was in an auto accident with an uninsured motorist, my car was totaled, he had no insurance so mine payed for the damages of my car, will he be sued by my insurance company for what they paid or Do I sue him? no injuries to anyone, in New York

Ask your insurance company. Usually they go after him, and prohibit you from suing him, and thus possibly fouling up their case. You are out the deductible, and they are out a lot more.
