accident not at fault vehicle totaled


What is the name of your state (only U.S. law)? MN
My daughter was rear ended at at red light in Zimmerman Mn. It has taken the other insurance company 48hrs to get me a rental. They are being very rude to us. My 2002 Ford F150 4x4 truck which was in excellent condition is being totaled. All I want is a replacement truck in like condition. My daughter was checked out at local emergency room by my insurance company. As of now she seems fine just bruised and sore. What are my rights should I sue, as I know they wont offer me enought compensation to replace my truck. They have told me it will take over a week to check out my truck and they wil call with their offer. What should I do. The state trooper told me to sue, The witnesses at accident said we should sue. I just want what we had. Not looking to be greedy.

You are not entitled to replacement cost, only the actual cash value of your vehicle in the condition it was in immediately before the accident. You have no reason to sue, especially not now.

Being in a no-fault accident where your vehicle is totaled stinks. Believe you me. My family has been in two. Both not at fault. The good news was all medical costs are paid for from different sources (PIP, our health ins, the at fault driver's ins, etc...). The bad news was that we basically get screwed when it comes to recovering from a vehicle being totaled. In both instances we ended up paying some money out of pocket to replace our vehicles. Yes, we could have used the ACV money to attempt to buy a like vehicle but it never seems to work out that way. The good news also is that your daughter is ok.
