Accident occured after insurance lapsed.

Florida. I was pulling out to the right of driveway going to the right and was hit. My head hit the windshield and I couldn't recall what had happened. The other driver gave three different accounts of what happened, blameing me. I have pictures of marks starting on my side of double solid yellow line leading to where wrecker picked her vehicle up. Officer didn't see marks. If ticket is overturned will her insurance company be liable for my car and medical bills? My name is Melissa and a friend let me use her email to be contacted. If you had personal injury protection (p.i.p.) coverage then your insurance should cover the medical bills.

The driver of the other vehicle will only be legally liable if he was negligent. His liability would be proportional to his percentage of negligence. The owner of the other car, assuming its not the same person, may also be liable.

The ticket is totally irrelevant to establish liability. The fact that you were ticketed shouldn't even get before a jury. Most laymen, especially adjusters, do not know this.
