| Accident Report Cites Other Driver at Fault What is the name of your state? CA
My son was in a minor accident while backing out of the driveway. He had pulled out into the road entirely, put the car in drive and was hit from behind. The speed limit on the street is 25mph. The other driver admitted in his statement to going 35 mph. There were two witnesses that confirmed that the driver was speeding and made very little attempt to stop also confirmed by lack of skid marks. The highway patrol report cited the other driver at fault based upon his own statement, witness statements, physical evidence and damage to both vehicles.
So here's the deal. This guys insurance company wants to pay for 75% of the cost to repair our vehicle, based upon their adjusters appraisal of the damages. We do not know that figure as we have not agreed to let the appraiser come out and look at the vehicle yet. Where do we go from here? This hardly seems fair.
