accident virgins try to make their case!


What is the name of your state?california


My boyfriend's truck was totaled in a wreck on Feb. 12. We stupidly didn't take photos. We were in shock. Now we have drawn diagrams. Our witnesses wanted to be paid off, so we now have only one witness who only saw the street lights change, but didn't see the wreck. 3 questions:

1) Is it worth it now, on Feb. 21, to go file a "front counter report" at the police station?

2) How is the case any more than "he said vs. he said?" Especially without witnesses?

3) Are WE actually in danger of being sued by the other driver?

Any advice would be really appreciated! We would like to actually get engaged, but this car wreck is sapping all our energy and definitely sapping our tiny savings!

your insurance carrier most likely took photos of the truck damage. Your boyfriend was insured, right?

filing a counter report with the police over 10 days after the accident has no value.

Is your boyfriend wanting to make a claim against the other driver or is he just trying to prepare against being sued?

Well, one of the witnesses who said he saw the accident wanted us to pay him 500 bucks to talk to the insurance agent. We didn't think this guy would be a reliable witness, so we called the insurance companies and told them this. (This gives you some idea of the kind of iffy neighborhood we live in in San Francisco!)

2)
No one was determined to be at fault. I never understood why the police wouldn't do this. I can't see why legally (as the daughter and granddaughter of lawyers) this small court claims case would be anymore than he said vs. he said.

Any further comments would be great!

I don't know if you have enough evidence, but there are accident reconstruction experts who can determine who was at fault. They are expensive.

This happens in non-iffy neighborhoods also.

thanks for your assistance, seniorjudge. i don't think the accident reconstruction folks are for us, tho' it's good to know they can be hired. and, i was just trying to add a little personality to these postings with my "iffy neighborhood" and legalistic upbringing comments. A little levity never hurts, esp. when bad things happen. Cheers, the A.V. team.

This forum is also a pretty iffy neighborhood....
