Accident w/ no damage - need advice

What is the name of your state? Washington DC

My wife rear ended a lawyer's car about 3 weeks ago going about 1 mph. He claimed she caused damage that was obviously old and didn't line up with my wife's car. He wouldn't call the police and when my wife eventually did they said it was too minor for them to look at. He only took my wife's driver's license info. We didn't contact our insurance company because we figured he realized he was an idiot and wasn't going to get any money for the previous damage. Now he has left us a message saying if he doesn't hear from our insurance company in 1 week he is taking us to court. What should we do? I don't want our insurance rates to go up, but I don't want to go to court either.
